Breach of Contract
MWL personnel served as an expert witness for counsel for the Seattle Times in the Hearst v. Seattle Times matter, a high-profile matter in the Seattle business community, in which the parties disputed the Seattle Times' right to terminate their Joint Operating Agreement entered into in the early 1980s pursuant to the Newspaper Preservation Act. We provided testimony on the subjects of proper application of generally accepted accounting principles to certain transactions, cost allocation issues among related entities, as well as economic justifications for certain major business decisions made by the Seattle Times that were challenged by Hearst pursuant to the Times’ management of the Joint Operating Agreement.
